4-7. REGULATIONS CONCERNING THE PREVENTION OF DISTURBANCE FROM AIRCRAFT NOISE, ETC., AROUND PUBLIC AERODROMES

 

(Method of Calculation, etc. of Aircraft Noise)
Article 1. The method of calculation as specified in Ordinances of the Ministry of Transport, under the provisions of Article 6 (Designation of First Class Area, Second Class Area and Third Class Area) of the Cabinet Order Relating to Prevention of Disturbance from Aircraft Noise etc. around Public Airports of Cabinet Order No 284, 1967 (hereinafter referred to as "Order") shall be according to the following calculation formula:

Remarks:
In this formula, the meaning of
dB (A) and N shall be as follows:
dB (A)...The value obtained from the weighted average of the level of noise of maximum incidence in the takeoffs and landings, respectively, of aircraft in any one day.
N...When the level of noise occurring during the period between 0:00 and 7:00 is specified as N1, that between 7:00 and 19:00 as N2, that between 19:00 and 22:00 as N3, and that between 22:00 and 24:00 as N4, the value obtained by the following calculation formula shall be N: N2 + 3N3 + (N1 + N4)
(2)The value under the preceding formula shall be calculated in cases when standard conditions can be provided for on an annual basis in reference to the type of aircraft, frequency of flights, air routes, flight hours, etc.

 

2. The value specified in Ordinances of the Ministry of Transport under the provisions of Article 6 of the Order shall be 75 in the case of first class areas, 90 in second class areas, and 95 in third class areas.

 

(Application for Approval of Increase in Capital)
Article 2. The Organization for Environmental Improvement Around Airport (hereinafter referred to as "Organization") shall, when it intends to obtain approval under Article 11 paragraph (Increase of Capital) of the Law concerning the Prevention of Disturbance by Aircraft around Aerodromes (Law No. 110, 1967) (hereinafter referred to as "Law"), submit an application to the Minister of Transport, describing the following matters:
(1)Amount of money representing the increase in capital;
(2)Reason for an increase in capital;
(3)Methods of raising funds;
(4)Utilization of the money to be obtained by the increase in capital;
(5)Method of repayment.
